New Delhi, March 19 -- The Delhi High Court has refused to stay the trial court proceedings against Delhi Law Minister Kapil Mishra for allegedly posting objectionable tweets during the 2020 assembly elections.
Justice Ravinder Dudeja issued notice to Delhi Police on the BJP leader's plea challenging a sessions court order that dismissed his petition against the summons of a magisterial court in the case.
Senior Advocate Mahesh Jethmalani represented Mishra and argued that the tweets did not mention any specific communities or groups, which is a necessary condition under Section 125 of the Representation of the People Act, 1951-the provision under which the FIR was registered.
