HC overturns acquittal of RJD MLA Ritlal Yadav
PATNA, Sept. 26 -- The Patna High Court on Thursday overturned the acquittal of RJD MLA from Danapur Ritlal Yadav and his associates in the high-profile Satyanarayan Sinha murder case and ordered a retrial, a major setback to the controversial legislator ahead of upcoming Assembly election.
On May 14, 2024 the special MP-MLA court of additional district and sessions judge-3 Vinay Prakash Tiwary, acquitted Ritlal Yadav, Ranjan Yadav alias Benga, Shrawan Yadav and Sunil Yadav alias Kana as the prosecution failed to successfully defend the case. However, the HC acted on a criminal appeal against the MLA and his associates filed by Asha Sinha, the slain leader's wife, herself three-term BJP MLA from 2005-2020, against the MLA and his associates, directing that the case be reopened and pursued under speedy trial provisions. Asha had challenged the acquittal of four persons including the RJD sitting MLA from Danapur, who was booked for murder of BJP leader Sinha in 2003.
The double bench comprising Justice Rajeev Ranjan Prasad and Justice Ashok Kumar Pandey set aside the impugned judgment and remitted the matter to the trial court once again for fresh consideration.
The court observed that earlier the trial of this case had already been delayed, therefore, all endeavours and efforts be made to decide the matter without granting unnecessary adjournments. It is expected that the trial court would decide the matter preferably within a period of four months from the date of receipt of this order with the trial court records....
