Sexual assault victim gets justice after 31 years
Lucknow, Feb. 3 -- After nearly three decades, justice was delivered in a 31-year-old case when a court convicted Nauratan Singh for attempting to rape an 11-year-old girl in Firozabad on May 6, 1995, relying primarily on the survivor's consistent and courageous testimony despite the death of key witnesses.
Special Judge Navneet Kumar Giri, SC-ST Act court, Firozabad, last week passed the order and sentenced Nauratan Singh, to five years of rigorous imprisonment and imposed a fine of Rs 14,000, with half going to the victim.
During the legal battle spanning 31 years, the victim's father (the complainant) and the main witness, her uncle, passed away, but the victim, even after three decades, exposed the accused through her testimony in court.
The victim revived the 31-year-old complaint by identifying her father's signatures in court.
Passing the order, the court observed, "While the victim may forget the dates or days as time passes, the wound of the brutality remains in the victim's mind forever and never heals."
The police registered a case based on the father's complaint, arrested the accused, and filed a charge sheet against him.
The defence argued that the victim did not remember the exact date of the incident, which the court rejected with a strong reprimand.
The court held that the scratch marks on the victim's face and body (according to the medical report) and her unwavering statements were sufficient to prove that she had been subjected to struggle and brutality that night.
In the Covid-19 period from 2020 -2022, the case got stuck. It was again revived in 2022 by the then district judge.
