Passport renewal a legitimate right: HC
PRAYAGRAJ, April 10 -- The Allahabad high court has observed that passport renewal is a legitimate right available to a person, which cannot be denied only on the basis of anxiety and fear that the person won't attend trial.
With this observation, the court directed the regional passport officer concerned to renew the petitioner's passport without delay.
Justice Saurabh Srivastava, while allowing an application filed by Dilip of Rampur, set aside the order of the additional chief judicial magistrate, Rampur. The ACJM had rejected the application for passport renewal.
The petitioner was working in Saudi Arabia and was accused in a criminal case, in which a non-bailable warrant was issued against him by the chief judicial magistrate, Rampur.
As his passport was expiring, the petitioner had moved an application before the ACJM, Rampur, seeking permission for renewal of his passport. The same was rejected by the ACJM by an order dated July 30, 2025. The petitioner challenged the ACJM's order before the high court.
During the hearing, the state counsel expressed the fear that in case the applicant's passport is renewed, there was no assurance or undertaking that the applicant will return to India and appear before the court concerned in pursuance of non-bailable warrants, which have already been issued against him.
The high court, in its judgment dated April 7, noted that the renewal of passport is the legitimate right available with the applicant and the same cannot be stopped only on the basis of anxiety and fear shown by the state counsel.
The court directed the ministry of external affairs, through its joint secretary (Middle East) to ensure service of this order upon the embassy in Saudi Arabia for enforcing the appearance of the applicant in pursuance of the non-bailable warrants issued by ACJM (Court No.1) , Rampur.
The court then directed the regional passport officer concerned to renew Dilip's passport without any delay, if there is no other impediment....
