Court accepts closure report in rape case against Hry BJP chief
Shimla, Jan. 9 -- Providing relief to Haryana BJP president Mohan Lal Badoli, a local court in Kasauli on Thursday, accepted the cancellation report filed by Kasauli police in a case of alleged gangrape lodged against 61-year-old Badoli, and singer Jai Bhagwan, popularly known as Rocky Mittal.
The case was filed against Badoli and Mittal in December 2024, following a complaint by a 28-year-old woman, who had alleged being raped by the duo in Kasauli in July 2023. The court on Thursday accepted the police closure report, giving Badoli and Mittal a clean chit. The victim woman also failed to appear in court. The closure report was filed after the police failed to get any evidence in the case.
The FIR was registered at the Kasauli police station on December 13, 2024, 17 months after the alleged incident. The woman had alleged that Badoli and Mittal had forced her to consume alcohol and raped her at a hotel in Kasauli in Solan district in July 2023.
She further alleged that the duo had shot compromising videos and photos of her. The woman had also refused to undergo medical examination and even the closed-circuit television (CCTV) camera footage was not available.
Earlier too on March 12 last year, the Kasauli court had accepted the closure report highlighting the significant delay of more than 17 months in reporting the incident by the victim, which makes her case doubtful. The friend of the victim, who as per victim was an eyewitness to the alleged incident, did not support allegations levelled by the victim. The friend of the victim denied the entire incident in her statement recorded in the court.
The court, while accepting the closure report, stated that, "The allegations levelled by the victim were also not supported and corroborated by the boss of the victim who had accompanied the victim to Kasauli. Lastly, there is no medical evidence on record to support allegations of rape levelled by the victim. Hence, for the aforesaid reasons, the cancellation report filed by SHO, Kasauli police station, was accepted."
Later, the victim challenged the Kasauli court's order that accepted a cancellation report. A senior police officer privy to the matter said, "The court has dismissed the woman's allegations. Due to a lack of evidence, the court upheld the police report. Consequently, it has been determined that Badoli and Mittal will not face rape charges."...
