JODHPUR, March 8 -- The Rajasthan High Court has dismissed the appeal of a man convicted of raping his minor daughter, upholding his life sentence. The court also directed the state government to pay compensation of Rs.7 lakh to the victim. A division bench of justices Vinit Kumar Mathur and Chandra Shekhar Sharma on Friday upheld the October 13, 2023 decision of the Special Pocso court. The court said that the trial court had convicted the accused based on the available evidence and imposed a just punishment, and there was no reason to interfere. According to the case, on March 27, 2023, the victim's cousin reported to the Desuri police station in Pali that his 14-year-old cousin had left home without informing them. Based on this report, the police registered a case of kidnapping and began an investigation. The investigation revealed that the minor had been sexually abused by her father for a long time. Subsequently, the police filed a charge sheet against the accused father under various sections of the IPC and the Pocso Act. The bench found that the victim, at the suggestion of her cousin, had filmed the rape by her father. The bench said: "It has been established that the accused-appellant, being the biological father of the victim, was under a sacred and moral duty to protect, nurture, and safeguard her. Instead, he repeatedly violated her bodily integrity and dignity over a prolonged period when she was merely 14 years old." "When such an offence is perpetrated by the father the crime assumes an aggravated and abhorrent dimension. It ceases to be a mere infraction of penal provisions and becomes a profound betrayal of the most sacred and foundational human relationship," it added....
