HC reserves order on local body polls delay
JODHPUR, May 12 -- The Rajasthan high court on Monday reserved its judgment on petitions concerning the delay in holding elections for Panchayati Raj Institutions and Urban Local Bodies after the State failed to conduct the polls by the April 15 deadline fixed earlier by the high court and recorded before the Supreme Court.
The bench of acting chief justice Sanjeev Prakash Sharma and justice Sanjeet Purohit concluded hearings after detailed arguments from the State Government, the State Election Commission and petitioner former MLA Sanyam Lodha.
Appearing for the State Government, Advocate General Rajendra Prasad submitted that the report of the OBC Commission was still pending and would take time to be finalised. He further argued that after the report is received, the State Election Commission would require at least one-and-a-half months to carry out the lottery process for reservation of wards and proceed with the election programme in accordance with reservation norms. On this basis, the State sought extension of time for conducting elections.
During the hearing, however, the bench expressed displeasure over the State's failure to conduct elections within the timeline despite assurances given before high court and top court.
The Court orally questioned why elections could not be conducted even without waiting for the OBC Commission report.
In his reply before the court, Lodha contended that there were no "unforeseen circumstances" justifying further delay and argued that continued administration of local bodies through administrators violated the constitutional mandate under Article 243-U....
