HC notice to child rights panel for delay in chief appointment
Jodhpur, Feb. 22 -- The Rajasthan High Court has sought a response from the state government regarding the prolonged delay in appointing a chairperson and members to the Rajasthan State Commission for Protection of Child Rights (RSCPCR), a statutory body constituted under the Commission for Protection of Child Rights Act, 2005.
A division bench comprising justice Dr Pushpendra Singh Bhati and justice Sandeep Shah issued the notice while hearing a Public Interest Litigation (PIL) filed by the Juvenile Justice Advocates Association (JJAA) on Friday.
According to the petition, the post of chairperson has been lying vacant since March 19, 2024, following the resignation of the then chairperson, Sangeeta Beniwal.
Despite a mandatory provision under Rule 5(7) of the Rajasthan State Commission for Protection of Child Rights Rules, 2010, which requires any vacancy to be filled within 60 days, the respondents have failed to make appointments for nearly one year and ten months.
The petitioner, represented by advocate Rajendra Kumar Soni, said that the Commission continues to function without duly constituted leadership, rendering it ineffective and defeating the very object of child protection legislation.
The petition further alleges that although the respondent department issued advertisements for the posts of chairperson and members on multiple occasions including June 19, 2024, April 16, 2025, and August 13, 2025 and received around 250 applications from eligible candidates, no appointment orders were issued.
The selection process was substantially completed, but the respondents arbitrarily withheld appointments without assigning any reason.
A fresh advertisement was issued on January 22, 2026, for the same posts, ignoring the earlier completed selection process....
