HC appoints 2 commissioners to probe Luni river road work
Jodhpur, Feb. 17 -- The Rajasthan high court has appointed two court commissioners to verify allegations that a road is being built on land recorded as part of the Luni River rather than on an existing unpaved road.
The division bench of justices Vinit Kumar Mathur and Chandra Shekhar Sharma on Friday heard a public interest litigation (PIL) filed by Pradushan Nivaran And Paryavaran Sanrakshan Samiti. The petition claims the respondents are deliberately constructing the road on recorded Luni River land, parallel to an existing kaccha road, instead of widening the latter. The case raises concerns over environmental damage and misuse of riverbed land in Jodhpur district.
A division bench of Justices Vinit Kumar Mathur and Chandra Shekhar Sharma, while hearing a PIL filed by Pradushan Nivaran And Paryavaran Sanrakshan Samiti, noted: "The present writ (PIL) petition has been filed against the construction of the road undertaken by the respondents on the bank of the Luni River and it has been averred that the construction of the road is being undertaken by the respondents deliberately on the land, which is recorded as land of Luni River, and instead of constructing the road on the kaccha road, which was already in existence, the road is being constructed parallel to that kaccha road towards the Luni River, leaving aside the kaccha road in existence as it is."
During the hearing, additional advocate general Rajesh Panwar disputed the claims. He said the road was built on the existing kaccha road, though some portions fall on recorded Luni River land. This was done, he added, in the larger public interest to ease traffic flow from Megha Highway to other city parts and link the Jasol-Balotara road.
"In this view of the matter, since the dispute has been raised as to whether the construction of the road has been made either on the kaccha road or on the Luni River, this Court deems it appropriate to appoint the Court Commissioners to find out the veracity of the matter as to whether the road has been constructed over the kaccha road or adjacent to the kaccha road towards the Luni River, or parallel to it. For this purpose, Divik Mathur and Himanshu Kaushik, advocates, are appointed as Court Commissioners to visit the site in question," the bench said....
