UT told to regularise services of lecturer on contract for 20 yrs
Chandigarh, April 4 -- The Central Administrative Tribunal (CAT) Chandigarh bench has directed the UT administration and UT secretary of technical education to regularise the services of Rajesh Verma, a lecturer at Chandigarh College of Engineering and Technology, Sector 26 where he had been working on contract for the past 20 years.
Rajesh Verma applied for the lecturer post at Chandigarh College of Engineering and Technology's diploma wing after an advertisement was issued for contractual appointments on September 23, 2007.
In his petition, he said that he was eligible as per the advertisement and was issued an appointment letter on October 1, 2007.
His tenure was extended from time to time by the respondents. He added that he had been working with an unblemished record, without any disciplinary proceedings or adverse remarks, and has been performing duties identical to those discharged by regularly appointed lecturers.
The respondents said that the applicant was engaged purely on a contractual basis as lecturer and his appointment was governed by the terms and conditions contained in the offer of appointment. The Tribunal observed that the high court had ruled that employees appointed through a transparent process against sanctioned posts cannot be denied regularisation merely on account of the nomenclature of their appointment being contractual.
The Tribunal directed respondents to regularise the services of the applicant to the post of lecturer (Production & Industrial Engineering) from a due date, keeping in view his initial appointment dated October 1, 2007, and continuous service, within a period of three months....
