NEW SOUTH WALES COURT ISSUES JUDGEMENTS FOR THE SECRETARY OF THE DEPARTMENT OF EDUCATION V/S SAFEWORK NSW CASE

Australia, April 21 -- New South Wales Land and Environment Court issued text of the following judgement on March 21:

1. The Secretary of the Department of Education ("Department") has filed two applications for external review pursuant to s 229 of the Work Health and Safety Act 2011 (NSW) ("WHS Act") of Improvement Notices No 7-476193-1 and 7-476196-1 ("INs") each dated 30 April 2024 (and issued to the Department on 5 June 2024) ("Review Applications"). The respondent in these matters is SafeWork NSW ("SafeWork").

2. At the commencement of the hearing of the Review Applications, the Department raised the following preliminary issues for determination by the Commission:
