1. On 23 May 2023, the applicant in these proceedings was terminated from his employment with the respondent for the stated reason of medical retirement (the "Dismissal"). This decision addresses the applicant's claim that the Dismissal was unfair under the Industrial Relations Act 1996 (NSW) (the "Act").
