Australia, March 12 -- New South Wales Land and Environment Court issued text of the following judgement on Feb. 12:
1. On 11 June 2024, a delegate of the Commissioner of Police, NSW Police Force (the appellant) refused Mr White's (the respondent's) application for a Class 1E security licence. The licence was refused on the ground that the respondent had, within the last 10 years, been convicted of an offence "involving fraud, dishonesty or stealing" and in those circumstances, s 16(1)(a) of the Security Industry Act 1997 (NSW) (the SI Act) read with cl 15 of the Security Industry Regulation 2016 (NSW) (the SI Regulation) required the appellant to refuse to grant the licence.
