ADAMSON JA: The Crown appeals pursuant to s 5D of the Criminal Appeal Act 1912 (NSW) against the sentence imposed by Priestley SC DCJ (the sentencing judge) on Starke (a pseudonym) (the respondent) on 15 September 2023 at the Lismore District Court.
Following a trial by jury over which the sentencing judge presided, the respondent was convicted of the following two offences, for which the maximum penalties, standard non-parole periods (SNPP) and indicative sentences are set out in the table below.
